What are considered to be deceptive trade practices?

There are several laws on the books including the Minnesota Antitrust Law of 1971 and the Federal Uniform Deceptive Trade Practices Act that have made it illegal for individuals or retailers to employ sales tactics aimed at getting a buyer to make a purchase.

These laws outline how several activities may be deemed as deceptive trade practices. The sale of services or goods including cigarettes below costs is considered illegal under the Minnesota Antitrust Law of 1971.

Any retailer that conspires with another company to restrain trade may also be sued for engaging in deceptive trade practices. Anyone who sells old products as new ones may be accused of this offense as well. Those who monopolize food resources or mislead consumers about where a product was produced, its ingredients or its quality may also be sued for deceptive trade practices too.

Minnesota law only allows a few select parties to file a lawsuit against a party thought to have engaged in deceptive trade practices. Only the individual likely to suffer damages or the county attorney or attorney general can file such a legal claim.

There are various remedies that a plaintiff may be entitled to if they win their case. One such remedy is an injunction. A plaintiff may also be entitled to both court and attorney's fees.

Individuals who are charged with tampering with an odometer reading may be charged with a gross misdemeanor. They may also be ordered to pay damages and legal fees.
